'Boardwalk Empire' Actress Claims Harvey Weinstein Raped Her Twice

Paz de la Huerta claims the ousted producer sexually assaulted her twice in 2010.

Paz de la Huerta is the latest to level allegations of sexual assault against disgraced movie producer Harvey Weinstein.
The actress, who spoke with CBS News, claims that in October 2010 the mogul offered her a ride home to her New York City apartment because they lived near each other. Weinstein insisted they have a drink, and the two eventually wound up in de la Huerta's apartment. Once there, Weinstein took off her dress and forced himself on her, de la Huerta alleges. 
The actress claims to the outlet that she confronted Weinstein in the lobby of the Four Seasons in Los Angeles more than a month later, saying that Weinstein had been repeatedly calling her. Later that same year, in December, de la Huerta claims Weinstein made an appearance in the lobby of her apartment complex, that the two went upstairs to her apartment, and that she was sexually assaulted again by Weinstein. The Boardwalk Empire star claims that she had been drinking at the time of the second encounter and was in no condition to consent to sexual activity. 
Weinstein is currently under investigation by the NYPD and LAPD for sexual assault. The number of accusers who claim he sexually harassed or assaulted them now numbers over 70. 
“We are aware of the sexual assault complaints. We are actively investigating them. The NYPD continues to work with the Manhattan District Attorney’s office on the case. The investigation is ongoing,” Sgt. Brendan Ryan of the NYPD told The Hollywood Reporter.
De la Huerta's lawyer Aaron Fuller, during a Friday appearance on NBC News' Megyn Kelly Today, said if Weinstein were in New York, where the first alleged assault took place, "he would likely be arrested." Fuller said the assault and stalking allegations really had a "tremendous" impact on the actress and believes the NYPD is going to make an arrest. "We're not really sure where he is. If he's in Arizona still," he said of Weinstein, who has a home in Tribeca. "This is the police view of it, and then whether the district attorney is prepared to file charges is up to their investigation."
